To Kill a Mokingbird Journals

Never kill a mocking bird A mockingbird is a harmless bird that makes the world more pleasant. In To Kill A Mockingbird by Harper Lee, the mockingbird symbolizes Boo Radley and Tom Robinson, who were both peaceful people who never did any harm. To kill or harm them would be a sin. Scout's father, Atticus, tells Scout and Jem, â€Å"I'd rather you shoot at tin cans in the backyard, but I know you'll go after birds. Shoot all the blue jays you want, if you can hit'em, but remember it's a sin to kill a mockingbird. â€Å"(p. 69) The mockingbird symbolizes these two characters because it does not have its own song.Whereas, the blue jay is loud and obnoxious, the mockingbird only sings other birds' songs. Therefore, the mockingbird is seen through the other birds. The people of Maycomb only knew Boo Radley and Tom Robinson by what others said about them. Both of these characters do not really have their own â€Å"song† in a sense, and therefore, are characterized by other people' s viewpoints. This statement is a great metaphor and comparison of Boo and Tom. They keep to themselves and only want to help out the community. Personally I do have a Boo Radley in my life. My mom likes to keep to herself and doesn’t really like to go out places. She always says that she is fine where she lives and she would never try to change the people around her. She really is a mockingbird she loves to cook and care for us. I know that if it was on her hands to save us and god forbid her being harmed in return, she is the angel of the family and even though she tries to keep to herself we and she knows that e love her very much. She is a very calm person and only cares for those around her. First day of school Scout had a really bad first day of school. She started off with the wrong foot with her teacher. Although she wanted to go to school, Scout had a horrific day.Her teacher was upset because Scout could read. She also tells her that she is not allowed to read out lo ud. The teacher loans the Cunningham money for his lunch. He says he can pay her back tomorrow, Scout explains that he won't be able to because he is from a poor family. Scout then gets her hands hit with a ruler. And at the end of hat school day, scout meets the Cunningham and beats him up in attempt to get back at him for making her start off the school on the wrong foot. I’m not a big fan of school. But then again, who is? I remember my first day of school, in America. It was bad I had no idea how to speak English due to that I was raised in Mexico. Kids would make fun and taunt me. It was really frustrating for me up through middle school until I â€Å"mastered† the language. I really do thank the kids that made fun of me though. It helped me try harder and harder. I don’t like to fight, and it’s kind of ironic because my dad always said â€Å"fight with your brain. Show them that you are in fact better than them. † And so I did I tried my harde st to be where I am now. Dead bird In to kill a mocking bird, Tom Robinson was convicted of a crime he did not commit. He was accused and convicted of raping Mayella Ewell, but the truth was that he never raped Mayella. It was all a cover up for Bob Ewell, Mayella’s father, for beating Mayella. The shown above is a mockingbird. As you can see it has been shot and it is dead, in the novel Atticus states that you should never kill a mocking bird because it is a sin. But this foreshadow for Tom Robinson. Tom Robinson is convicted purely because he is a black man and his accuser is white. The evidence is in his favor, that race is clearly the single defining factor in the jury's decision.Atticus fights against racism, and a few other townspeople are on his side, including Miss Maudie and Judge Taylor. Jem and Scout also believe in racial equality, but are obviously in the minority because they’re kids. After the trial, Tom was taken to Enfield Prison Farm, which was about 7 0 miles away. This is where he would attempt to escape and be shot to death. This is a very ugly side of the world. Tom was killed for a crime he did not commit. It was al because he was balck and he lived on the south. Going back to his rights there were no blacks on the jury. Also he stated that he felt sorry for the girl. he helped when she asked for it.He was only there to help and he ot stabbed in the back by them. Victory without winning. Well, the question is how Atticus is victorious, not whether or not he won the case. Think about it, if you read the book. He got to bring out the truth, and he stood for right against everyone, even though it might cost him his place in the society of that small town. Ultimately, people respected him. Racism such as in To Kill a Mockingbird sometimes goes on because individuals do not feel racist but they continue in fear of their neighbors thoughts. Atticus stood for the moral high ground regardless of people and his defense was flawless.Ev en though the jury still voted out of fear and ignorance. Atticus really shows what the right thing to do is and that help the community as much as you can. Miss Maudie considers this as progress and a positive step towards real justice, although it may be a small, it is still â€Å"one in the right direction†. Atticus adds that although he cannot be sure who it was, at least one person on the jury took an initial stance for Tom's innocence, and he thinks that person was Mr. Cunningham. He guesses this from the awkward writing on the slip of paper used to write the verdict.Atticus makes a great fight for justice in this case and is respected in his whole town. I think that now people will start to respect the African americans in their community because they’ve been mistreated for so long and Atticus makes the first step in that town. Tree Findings One day Scout finds gum in the tree near the Radley home. On the last day of school the Jem and Scout walked home together in their way, they find a package covered with foil and containing two scrubbed, Indian-head pennies and two Soap Dolls of a boy and a girl  that looked like them in the tree near the Radley Place. They think Boo put them there for them to find. Throughout the story the kids try to get a peek at Boo but they never can, but in many pccasion Boo helps the kids and protects them. Near the end of the story Boo saves Jem And Scout from nearly being killed. He kills Bob Ewell by stabbing him, thus saving the Finches. Boo Radley really remind me of my grandparents. When I was a kid they would always hide gifts around the house, and told us to find them, once year they hid stuff on the trees in or back yard and it took us 2 days to find them all. They really knew how to make us waste time and play around. Another similarity between them is that they always tried to protect us even if had done something bad. They would always tell my mom not to yell us for doing bad stuff, but she still did . My grandparents really took care of us when we were young and I’m really thankful for it. Role Model. Atticus can be described as a calm, courageous, intelligent and intellectual man, who understands human nature and f moral values in life. Jem makes it clear that he is his role model. He wants to be just like him. They both show their need for each other. Throughout the novel, their relationship continually grows stronger as they remain supportive for each other. In the beginning He felt humiliated because Atticus was different from other parents. Atticus was a lot older and did not fish and hunt like other parents. Jem’s feelings towards Atticus change. When, the mad dog was coming towards the finch’s home and Atticus is called immediately. To Jem’s greatest surprise, Atticus shoots the dog without any hesitation. My role model Is my father. He has been though a lot during his life. From him getting married when he was 16. He has made it this far in lif e with 3 kids that look up to him. He has had 2 vertebral operation and an arm operation and he is still o top of his â€Å"game†. My father is the strongest man in the world and I respect him for being who he is. He Is a straight forward man and isn’t afraid to speak his mind. He would always tell me to â€Å"fight with my brain and not my arms† which I find very ironic due to that that is what is said in the novel. he has helped me through so much and I thank god for giving me the best father of them all.No offence to all other fathers but mine is the best. Growing up. Scout and Jem grew up in a small town where everyone knew everyone, and everybody followed the same costumes. But her family was different. They didn’t follow the costumes they adopted Atticus’ way of life and way to see it. Most of the people from Maycomb were arrogant, racist, ignorant man from the south. Atticus was different he didn’t believe in racism he stood for what was right at all times and taught his children this way. Scout and Jem had not sin in their hearts but they knew right from wrong. They knew that the people of Maycomb were ignorant and were treating not only Tom Robinson but the other blacks and boo the same way. The way I was raised I was always told to not look down on people. My parents always said that everyone is going to be better than you at some things and you have to deal with it and if you don’t want to, well then try harder. I was always told not to discriminate others because I would be discriminated too, for being Hispanic. The one thing I really never want to lose is respect. Respect is the most important feature to have if you have respect you have trust and everything derives from respect. If you don’t have respect you don’t have anything, Atticus had a lot of respect from other he was the talk of the town. He and his family gained a lot of respect because of Atticus and how he made a step forward and set an example in his town. Don’t judge a book by its cover. Susan Boyle is a Scottish singer who came to public attention when she appeared as a contestant on the TV show Britain's Got Talent singing â€Å"I Dreamed a Dream†. At the beginning she seemed unimpressive she seemed like she was just going to embarrass herself. People thought she had no talent and that she was goober.Simon the judge from Britain’s got talent was very skeptical and even laughed at her so did many people from the audience. But to their surprise Susan shut them and up and showed them who was boss. She was an extraordinary singer. Claps and cheers were heard from the stands. When you watch the video of the performance it will sure give you goose bumps. Jem and scout were also skeptical about Atticus. He never played football or went hunting like all the other parents. He wouldn’t even teach them how to use the air rifles when he bought them for them. They were ashamed of him because he wasn’t very manly or outdoorsy. But one day when a mad dog was heading towards the finch’s house Atticus was called home from the city in attempt to protect his kids. To everyone’s surprise Atticus shot the dog in the head with one bullet, while the dog was running. This really shocked Scout and Jem because they had never seen this side of their father. Heck Tate told the kids that his father was nicknamed â€Å"one shot finch† for his great accuracy with guns. Both Atticus and Susan surprised the people around them because they didn’t appear to have the required abilities to do what did, but they ended up being pretty darn good at it.

Achievement Motivation Essay Example for Free

Achievement Motivation Essay ? What is it? This links personality with the degree of competitiveness shown by an individual. Its main focus is the extent to which an individual is motivated to attain success. Some Theories about it   Murray (1938) indicated that it was natural for individual to strive to surpass another (genetically) like trait. Bandura (1977) believed that a competitive drive was a product of learning (social learning). Atkinson and McCelland (1976) has the view of an interactionist and predicts achievement motivation is generated through a combination of personality and situation factors. Atkinson and McCelland view of achievement motivation as a personality trait which is activated by a situation, the situation comprises the probability of success and the incentive value of success. -Probability of success;the extent to which success is likely; For example success is more likely of the task is found by the individual to be easy. -Incentive value of success;the incentive value experienced by the individual after success-been achieved. For example the harder the task the greater will be the incentive value because the probability of success is reduced. There are two personality types to determine achievement motivation and these are; Linked with the low need to avoid failure (Low Naf). With these characteristic, desire to succeed overcomes the fear of failure. These performers=high in achievement motivation (high achievers) 2.Low need to achieve (Low Nach) Also linked with high need to avoid failure (High Naf). These characteristics the fear of failure overcome the desire to success. These performers=low in achievement motivation (low achievers) Characteristics of high and low achievement motivation personality traits. High Nach Personality Characteristics Low Nach personality characteristics High need to achieve Low need to achieve Low need to avoid failure High need to avoid failure Approach behaviour is adopted Avoidance behaviour is adopted Challenges is accepted Challenges is rejected Risks are undertaken Risks are declined Shows persistence and perseverance when task is difficult Curtails effort when task is difficult Success tends to be attributed to external factors Failure tends to be attributed to internal factors Failure is seen as a route to success Failure is seen as the route to further failure Aspire to mastery orientation Adopt learned helpessness Approach behaviour-describes behaviour that accepts a challenge Avoidance behaviour-describes behaviour that rejects a challenge Attribution-The process that predict reasons for success or failure Mastery Orientation-The strong motive to succeed found in the high achievement. This type of person will expect to succeed but will persist when failure is experienced Learned helplessness-The belief that failure is inevitable and that the individual has no control over the factors that cause failure. Their theory of achievement motivation is best at predicting behavioural responses in situations where there is a 50/50 chance of success. This will trigger motivation for those performers with high achievement traits=likely  to display approach behaviour and mastery orientation characteristics in these circumstances. Incentive value=high when chance is evenly balanced. In contrast to performers who show low achievement motivation would experience greatest anxiety in situations with a 50/50 chance of success— later adopt avoidance behaviour and experience learned helplessness. Approach or avoidance behaviours likely to arise when in a evaluative situation=Situation in which an individual believes they are being assessed. 1.Achievement or success can interpreted in many ways. Some performers regard success as victory over others. For example a long jump athlete winning an event. These people are said to have ego goal orientation. Those with this believe that ability and comparison over others=criteria for success. 2.Others judge on the basis of person improvement in a given task-For example a second long jump athlete may view success as the achievement of an improved performance. These people are said to have task orientation. Those with the task orientation value internal goals and believe that effort and comparison with self=criteria for success. Sport Specific Achievement Motivation(Competitiveness) Competitiveness in this context means- motivation to achieve in sport. Gill and Deeter (1988), using their own test called the ‘Sport Orientation Questionnaire’ (SOQ), confirmed that athletes were far more competitive than non-athletes. As as statement, this would appear obvious. Evidence of greater significance-athletes favoured performance goals (task orientation) while non-athletes emphasised the importance of winning (ego orientation) The type of goal set by the teacher as the measure of success in sport-related activities has, therefore, a significant influence upon the decision to adopt and sustain an active and healthy lifestyle. The important association between sport-specific motivation (competitiveness), confidence and goal setting. Achievement Motivation. (2016, May 10).

It acts positively in infrastructure development and efficient use of the project (Project Integration, p.1). Business value talks about the company's condition and strength in the long term. When we consider the business value we not only mean the firm's worth and value in the future only, but also its importance and usefulness to all its stakeholders including customers, suppliers, shareholders etc. In addition to it, for the measure of any organization's business value both tangible and intangible assets are equally important. For years the concept of business value is taken into consideration in many different ways but one cannot deny the fact that the linkage of external environment with the internal environment of the company has an impact on the business value as a whole. It is immensely important for the success and growth of an organization that all the related areas are linked effectively so that a perfect business value for a firm can be maintained (Business Value, p.1). On the contrary, real estate market value deals with the immovable property or land along with anything that is built on it, for example building.

Taiwanese and American Art - Thesis Example Still, the Eastern art had a thoughtful impact on Western impressionists where the work was hailed as the ultimate performance art form by master dramatists (Hong 2005). A number of Western artists have expressed their fascination with the spirit of nature in Chinese paintings and how Chinese artists imprison it in a few strokes, thereby, making the blank space on a canvas as reminiscent as the painting itself (Hong 2005). The delineation of Chinese ink and wash landscapes held by this contemporary has caused a substantial blend within the capital's art circles. The last few decades have witnessed a blast in the ideas as well as the theories of art, for it has never been more popular, however, much present thinking remains out-of-the-way and difficult to use (Costello 2007). This thesis effectually delineates the Hybridity and association of the Eastern art with that of the West. Homosexuality - Nature versus Nurture Research Paper

Homosexuality - Nature versus Nurture - Research Paper Example The truth is in understanding the nature concept; this is a concept that looks at how it is a specific gene combination within the body of a human being that makes him the way he is when he is born. It is these genes at the time of birth of a person that decides his sexual orientation rather than anything else. Therefore, people are born queer or gay rather than becoming gay during the course of their lifetime. In keeping with the statements and views made by the American Psychological Association, it has been noted that â€Å"Research suggests that the homosexual orientation is in place very early in the life cycle, possibly even before birth. It is found in about ten percent of the population, a figure which is surprisingly constant across cultures, irrespective of the different moral values and standards of a particular culture.† Therefore it is the belief of such associations as well as some independent scientists, that it is the gene make of different factors within the body, linked with the hormone secretions of a particular fetus that determines the final orientation of the baby at the time of its birth (or even before, when it is in the womb). On the other hand, the nurture concept talks about an entirely different aspect of being a homosexual. According to this concept, some people become gay during the course of their lifetime. They change their sexual preferences according to the kind of environment they live in, and according to the kind of surroundings and atmosphere they are subject to. For example, it is very likely for a young boy raised by only women (May it be in foster care, or lesbian parents, or simply having more women family members than male) to start behaving like women around him. By the time the boy is an adolescent or even older, all his preferences and tastes develop according to the likes of the women he has grown up with, and thus he begins to give rise to feelings of being effeminate. Therefore, this is how a person is ‘made’ gay rather than being born gay, all because of the influence of his outer surroundings and the external atmosphere.

Reconstruction Essay Example | Topics and Well Written Essays - 750 words

Reconstruction - Essay Example This is regardless of passing of 13Th, 14Th and 15th amendments intended to grant Blacks more rights besides voting. For instance, Northerners during Lincoln’s regime felt the then incumbent president was extremely slow in effecting significant laws meant to make Blacks enjoy similar privileges like any other citizen. Therefore, they ended up pressuring the president though at his pace he was capable of seeing some plans towards Blacks’ freedom realized. However, Johnson who was his successor proved to be totally against Blacks’ freedom and the entire reconstruction process thus causing confusion besides making it less efficient. Therefore, Dubois was right when he termed efforts exhibited during reconstruction era intended to make Black men Americans citizens were â€Å"splendid failure† because racism, utter segregation and ill-treatment of Blacks continued to be the norm of the day. During then, Blacks unlike other people continued to experience utter i ll treatment from their white counterparts especially in the Southern regions. This was to the extent of not having legal protection against open vandalism subjected on them and eventually no actions put in place to bring those responsible to the book. According to New York Times, Blacks were â€Å"†¦Ã¢â‚¬ ¦.quietly endeavoring to make arrangements to dispose of their property and emigrate to States where their persons will be secure against unprovoked assault, and where their property will be protected against vandalism† (â€Å"New York Times†). This is because somehow the government of the day contributed to Blacks’ woes especially during Johnson’s era who contrary to Lincoln exhibited little interest in ensuring they were safe. Therefore, Blacks opted to relocate to the regions where they would receive fair treatment as advocated by Northerners. Relocating in this case seemed as an effective solution to their woes because Blacks during then felt u nease to report to the legal authorities any incidences of injustice fearing intimidation and victimization. Hence, theirs was a completely losing battle especially in equaling whites because the government of the day favored only the latter. Reconstruction era despite the then authorities seeming to recognize Blacks’ presence and dignity, it was hard for them to enjoy same privileges as their white counterparts. This is especially during Johnson’s regime, which was extremely opposite of what Lincoln anticipated to implement though being slow to ensure Blacks’ safety. According to Special Field Orders there were â€Å"†¦Ã¢â‚¬ ¦400,000 acres along the Georgia and South Carolina coasts abandoned by white planters be confiscated and divided into 40 acre parcels (Mooney, 15).† Conversely, all these plans Johnson revoked them leading to immense loss of homes, crops and land besides making numerous dreams of freed slaves undergo â€Å"unexpected miscarria ge†. This incidence besides others and even hatred towards Blacks acted as sure prove African Americans during reconstruction epoch were not even near to be â€Å"true citizens†. Therefore, they were only in foreign state where the central regime pretended to care about them but in real sense openly exhibited the contrary though using laws to do so. This is evident in Litwack’s sentiments citing, â€Å"

Principles of International Relations - Group Assignment Essay

Principles of International Relations - Group Assignment - Essay Example astrophic and irreversible environmental consequences such as decline in global food production, extreme precipitation and destruction of the natural ecosystem and biodiversity. The extreme summer heat waves could lead to adverse health impacts on human beings and increase the prevalence of vector-borne diseases (Luterbacher & Sprinz, 2001). The development of climate change was initially constrained to scientific conferences since scientists established that carbon dioxide concentrations in the atmosphere were increasing in the 1960s. The Villach Conference of 1985 organized by United Nations Environmental Program concluded that states should initiate consideration on a global climate change convention thus creating an agenda for policy makers to address climate change (Paterson, 2013). Countries such as Germany and Canada were concerned with the increased depletion of stratospheric ozone layer, pollution of oceans and loss of biodiversity thus forcing scientists to carry out more research that led to discovery of Antarctic ozone hole (Luterbacher & Sprinz, 2001). The Northern American heat wave of 1988 summer boosted greenhouse warming agenda in Canada and the United States and thus led to the Toronto Conference of June 1988 that called for reduction of the global carbon dioxide emissions by 20 percent by the year 200 5 (Victor, 2011). Countries like Canada and Japan have committed to reducing greenhouse gases emission since global warming is an environmental disaster that has led to natural disasters in countries in the East Asia region (Paterson, 2013). The Toronto Conference marked the involvement of international actors such as non-governmental actors in environmental and states thus making global warming an international issue. The United Nations Assembly made climate change a common concern for mankind in 1988 while the Noordwijk Conference of 1989 in Netherlands concluded that industrialized nations should maintain their greenhouse gas emissions

Optional ethnicity Essay Example | Topics and Well Written Essays - 1250 words

Optional ethnicity - Essay Example On the other hand, it is true that the non-whites are not capable of choosing their ethnicities, even if they adopted the most popular ethnic symbols of the White ethnicities. On the other hand, it is also true that the Whites choose their ethnicities based on the amount of negative consequences. Waters claims that in the United States, the White Americans have the opportunity to choose their ethnicities, unlike the other minority groups. White Americans can either choose to be plain ‘White’ or choose an ethnicity, with regard to their ancestry. Waters also focuses on symbolic ethnicity, which she associates with later-generations of most White Americans. In this type of ethnicity, the individuals involved do not experience any social cost. This is because of the symbolic identifications in the ethnic group, which attracts later-generations to identify with. For instance, some whites might identify with the Irish Americans only during the special occasions such as vacati ons, or family holidays (Waters 3). Waters also notes that the whites are not influenced by ethnicity, compared to the minority groups in the US (4). In addition, they are at liberty to either choose their ethnicity, from their genealogies or not choose any, unlike the minority groups, who have to identify themselves with their identity. Symbolic identity mainly occurs among the whites, when they identify themselves with different ethnicities by adopting the popular ethnic symbols of those ethnicities. For instance, celebrating St. Patrick’s Day in order to be associated with the Irish ethnicity, thus, signaling their Irish ethnicity. However, a non-white celebrating St. Patrick’s Day will not be regarded Irish, since these are not capable of optional ethnicities. Waters introduces another element of ethnicity, which is the ‘non-optional’ ethnicity. This is the opposite of optional ethnicity, and mainly affects the minority. Unlike optional ethnicity, whic h is chosen with a free will, non-optional ethnicity is imposed on individuals. Oppositional ethnicity also affects the minority groups in society. In this type of ethnicity, members of the minority groups will seek companionship among themselves, and sometimes distance themselves from the mainstream population. In this case, the minority group will want to maintain their identity, which could be influenced by their history, or their uniqueness, with regard to other factors. The remaining members mostly judge the people who abandon this kind of ethnicity in a negative way. Waters attributes this ethnicity to the blacks and the Latinos. She believes that, â€Å"the oppositional component of a black identity also explains how black people can question whether other black are acting black enough† (Waters 7). In this case, the blacks or any ethnic minority groups are expected to act according to the values of their group, which is different from those of the mainstream population , and any deviance by one member is questionable. In the article Notes of a Native Speaker, Erick Liu talks about his experiences that relate to his ethnicity, immigration, and race, during his childhood and teenage years. Although Liu was Chinese, after immigration, he became a Chinese-American. However, he was called ‘banana’ by other Asians, for emulating the values of White Americans. Liu experienced vast challenges adapting to life in America, especially with regard to culture. Even though he was a citizen of

Hospitality and Destiny in the Odyssey and Sundiata Essay Example for Free

Hospitality and Destiny in the Odyssey and Sundiata Essay Princetons Wordnet defines hospitality as [the act of] cordial reception: [or] kindness in welcoming guests or strangers. Since the start of this semester, we have read about two different journeys in which hospitality plays an important role in fulfilling the destiny of the main character. In Homers Odyssey, many examples of this are apparent, whether they are for the benefit or the downfall of the protagonist Odysseus. However, Odysseus is not the only one whom hospitality rules. His son Telemachus also is affected by his hospitality towards others. In Nianes Sundiata: An Epic of Old Mali, the theme of hospitality runs thick throughout the narrative, as Sundiata is greatly affected by how the other characters receive him. If it were not for the hospitable acts shown to both of the weary travelers, Odysseus and Sundiata may not have been able to return to their homeland. The extreme observance of hospitality in the two texts may be compared with the golden rule: treat others, as you would like to be treated. The rule of hospitality may also be applied to the gods. In the time of Odysseus, gods or deities could take the form of humans or alter human appearance. If a stranger showed up at your door, you might not know whether they are mortal or immortal. If you turned away a god or someone loved by the gods, this could anger them and in turn they could avenge your inhospitable act. The gods might respond with not giving you a good harvest or make your life a complete hell, as Poseidon did to the journey of Odysseus. Good hospitality was to be displayed towards everyone, no matter age or gender. In The Odyssey, not only was Odysseus treated well by the lords of the lands he visited, but, his young son, Telemachus, was treated with respect. In Sundiata, hospitality was not only showed towards men, but also women. When Sassouma forced Sogolon into exile, the neighboring lands and kings she and her children encountered treated them with generosity. In The Odyssey many hospitable acts were displayed before kings even knew who had ventured to their land. When Telemachus travels to Pylos seeking information about his father, King Nestor treated him and Pallas Athena with much respect. As they approached the citadel King Nestor and his son spotted them. As soon as they saw the strangers, all came crowding down, urging  them to sit. Nestors son Pisistratus, first to reach them, grasped their hands and sat them down at the feast on fleecy throws (Homer 108, lines 39-44). This demonstrates how welcoming the Pylians are towards strangers. This is truly a hospitable greeting because the Pylians were not just carousing around, but in fact were involved in a feast in honor of the god Poseidon. They invited these foreign guests in as if they were members of the royal family to take part in the feast. Menelaus, like Nestor, treated his guest as part of the royal family before knowing their names. Menelaus provided Telemachus and Pisistratus with food but not just any food but, He passed them a fat rich loin with his own hands, the choicest part, that hed been served himself (Homer 126, 74-75). The Greeks loved to eat and what an honor it would have been to be given the kings slab of meat. He also had women bathe them, rub them with oil, and provide them with warm fleece and shirts to wear. Before Telemachus was to leave, Menelaus insisted on giving him many gifts but Odysseus young son respectfully declined any such gifts. Menelaus insisted on giving him a mixing bowl forged to perfection made of solid silver with a lip of gold made by Hephaestus himself (Homer 144, 692-694). The hospitality shown by Menelaus is a great example of treating others as you would like to be treated. Menelaus, the great and lustrous king, showered his guest with the best of everything, as he would have wanted done for him. Not only in The Odyssey and ancient Greece was hospitality shown towards strangers, but it also occurred in Sundiata. The first stop on the exile journey of Sundiata was Djedeba. The king there received them with a little mistrust, but mentioned that everywhere the stranger enjoys the right to hospitality (Niane 29). The stay with the king of Djedeba lasted two months and not much is mentioned in the novel of what was given to Sundiata and his family. But the stay with Djedeba emphasizes the point that even though someone may be wary of allowing strangers to stay with them, the act of hospitality is entitled to all strangers who need a place to stay. Those who were members of the highest social class were not the only ones expected to practice hospitality. Hospitable acts were to be practiced by  and towards all social classes. When Odysseus returned to Ithaca, Athena disguised him by dressing him in beggar clothes. She directed him towards the swineherds establishment. The swineherd had to save the king from his beastly dogs and after this invited him into his home. The swineherd, Eumeaus, told Odysseus, Its wrong, my friend, to send any stranger packing-even one who arrives in worse shape than you (Homer 303, 64-65). Odysseus told him, May Zeus and the other gods give you your hearts desire for the royal welcome you have shown me here (Homer 303, 60-62). The hospitality that was shown towards the beloved king no doubt pleased the gods. Even though the swineherd could not provide the extravagant baths, bedding, and food of kings, he still gave Odysseus the best of what he had. Odysseus was invited by the swineherd to sit down on a pile of brush and twigs covered with the skin of a shaggy wild goat, which was the swineherds own good bedding. He fed the king scrawny pigs that were freshly slaughtered. This was the best food that could be offered by the swineherd because the suitors who overran the home of Odysseus took the fattened pigs. The hospitality shown by the swineherd proves that one does not have to offer the best of things to show hospitality towards strangers. Hospitable acts were not expected only to be shown towards the living, but the deceased deserved the same rights. In Sundiata, when it came time to leave Mema and return to Mali, Sogolon passed away. Sundiata said to the king, King, you gave me hospitality at your court when I was without shelter†¦In any case, allow me to bury my mother before I go (Niane 46). The king was outraged that Sundiata wanted to leave his country and at first refused. But either it was fear, or out of respect he had for Sundiata, or a combination of both, Sundiata got his wish. Burial grounds were provided for Sogolon in the country of Mema. Showing hospitality towards the dead is as important towards showing it towards the living. Hospitality was not to go unnoticed either; hospitable acts were expected to be repaid when the time arose. A great example of repaying hospitality came from Menelaus. Telemachus and Nestors son arrived outside the gates of  Menelaus estate and lord Eteoneus runs through the halls and delivers the news to the battle-hardened king and ask, Should we unhitch their team for them or send them to someone free to host them well(Homer 125, 33-34)? Menelaus responds hastily, Just think of the hospitality we enjoyed at the hands of other men before we made it home†¦And bring them in strangers, guest, to share our flowing feast(Homer 125, 38-39, 41-42). Menelaus wants to show the same hospitality to those who visit his land just as the rulers showed him when he was in need. Political alliances also proved to be good situations to practice hospitality. One of the stops on the exile journey of Sundiata and his family was the region of Ghana. When they arrived they were greeted by the kings brother who made them comfortable and brought water for them to quench their thirst. After Sogolon explained where they were from and why they were in exile the king, Soumamba, responded, No one has ever found our hospitality wanting. My court is your court and my palace is yours (Niane 34). The reason for easy welcoming of the strangers was the history of the relationship between Mali and Ghana. The king also said to his brother, Brother, look after our guests. Let Sogolon and her children be royally treated and from tomorrow let the princes of Mali sit among our children (Niane 34). Another hospitable act in Sundiata, which involved alliances between nations, happened again in Mema. This alliance had to do with the family relationship of two kings. Upon their arrival at Mema, the sister of the king greeted Sogolon and her family and housed them in a wing of the palace. They were recommended by Soumaba to come to Mema, and after showing the king of Mema, Moussa Tounkara, a letter from Soumamba the king said, My cousin Soumaba recommends you and that is enough. You are at home. Stay here as long as you wish (Niane 36). Sundiata became so beloved by the people and the king that he became viceroy and even secured a spot as heir to the throne of Mema. This is example of hospitality starts out as a friendly gesture, and evolves into a new set of hierarchal position for the traveling family. The hospitality shown by the people of Mema allowed the exiled royal family of Mali to become pretty much citizens of this new country. The act of hospitality is prevalent in both the Odyssey and Sundiata. Not  only do kings of regions and countries practice this act, but hospitality is expected to be practiced by everyone regardless of their social class. Hospitality should be shown towards everyone regardless how the two parties affiliate with one another. Hospitality goes along way in the stories of Odysseus and Sundiata. It creates relationships with lands that others fear, like the region of Ghana in Sundiata. It also creates relationships with those who have no prior relationships to those of foreign lands, like Telemachus creates with the comrades of his father. If only this type of hospitality was prevalent in society today our world would be a much more friendly and fearless place to live. Fagles, Robert. The Odyssey. New York: Penguin, 1996. Niane, D. T. Analysis of the Road Not Taken by Robert Frost Essay Example for Free

Analysis of the Road Not Taken by Robert Frost Essay The Road Not Taken by Robert Frost shows the narrator coming to a fork in the wood, which offers two paths to take. By use of symbolism and various verb tenses in different stanzas the author was able to convey the overall meaning of the poem. The narrator scrutinized the road but does not find a noticeable difference in the two paths and thus was stuck deciding whether which road is the better decision. However, in the fourth stanza, by the allegory â€Å"I took the one less traveled by† shows that the narrator wishes to take the path which leads to individualism. The narrator portrayed that in life there are decisions we must make that must be based on our own agenda. Symbols also play in defining the meaning of the poem. The symbol of the color yellow is use to show more than just the narrator’s cowardice, but also yellow represents autumn meaning the author is at the end of his life which indicates that he has wasted his whole life in indecision. Other symbols such as â€Å"two roads† and â€Å"one traveler† in the first stanza show the idea of free choice and individualism of the narrator. We can also tie in to the fact that because the roads lies in the woods, and that roads represents free choice, the overall idea would be comparable to free choice and fate. You are free to choose what choice to make but in the end the choices you make are still a part of your fate. In the first three stanzas the poem is written in past tense, but in the fourth stanza the poem is written in future tense. By repeating â€Å"two roads diverged in a wood† in the fourth stanza the narrator is implying that he is reflecting upon if the choice he had made was the better of the two choices. The first three stanzas of the poem being in past tense hints that he is looking back at his past, but the fourth stanza shows us the narrator is hoping â€Å"somewhere ages and ages hence† the decision he made will benefit him. In addition, because the narrator is still uncertain if the choice he made was the better of the two, we can concludes that he is still reflective on whether which road he should have took, hence the title â€Å"The Road Not Taken. † Partially, the poem tells us about the narrator’s fear of regrets which eventually leads to his indecisiveness in choice of what road to travel. The fear of making mistakes from either choice had excluded the narrator from taking any action. . Frost’s point is to acknowledge the fact that in life there are choices where uncertainty makes choosing difficult, and often we are paralyzed by the fact of making the â€Å"wrong choice. † Words such as â€Å"sorry,† â€Å"sigh,† and â€Å"doubted† shows the authors regrets and concern for making the wrong choice. The last stanza offered the author’s apprehension furthermore of whether which road he should take with the stuttered â€Å"I. † Although in the last two lines the narrator says he takes â€Å"the [road] less traveled by, and that has made all the difference,† the use of the word difference is ironic to what the poem has states in retrospective about the similarity of the roads. In the poem The Road Not Taken the narrator’s idea of non-conformity coupled with the fear of regrets from making the wrong choice apprehended him from making any decisions. The Road Not Taken shows us that the choices we make in life should be based on our individual values.

Richard Cory

Richard Cory Richard Cory Poems are probably the best thing around the world there are so many poems that either explain a sense of feeling, anger, disappointment, illusion or also signify a way of showing love. Some of the things that go around the world are probably express in poems, letters and songs, which in later times this expression come to each individual and express the significance of the meaning of each poem or song to tell the individual what is happening around the world. The poem â€Å"Richard Cory† by Edwin Arlington Robinson has something in meaning either about people who are rich but also those that work off each time to get the food on their table every day. The poem and the song have their difference and similarities, but in particular who is Richard Cory, politics, and social influences. At the beginning of the poem we come to understand that it is talking about a man named Richard Cory, a man that is wealthy and well known to the town he lives in. The author introduces the reader with a sentence that says â€Å"We people on the pavement looked at him† coming to question the significance of â€Å"we† it is not clear to the reader how â€Å"we† comes is interpret in the poem. Is it the people on the town or the people that surround Richard Cory? According to a quote in Oppapers .com it specifies that â€Å"Richard Cory† is known as a â€Å"symbolic of upper society, and the towns people are symbolic of the middle class.† Richard Cory does not want any other human being to be just like him; this is probably why he is known as a powerful individual. A part of the poem mention how â€Å"he was a gentleman from sole to crown† taking place that the words in particular mean something to the poem itself. Sole and crown come to mean t hat one of a kind human being having a dominion of a sovereign (monarchy), making people feel he is as dominant as a king. He acts as a well educated and outstanding person that all the people around him admire the vivid image they saw in him as a God. Having a little understanding of who really is Richard Cory, we have knowledge to determine that people wish they could be at the same level as him, â€Å"richer than a king† understanding this is obviously unpredictable because according to the website Cummings guide it says â€Å"suggest Richard Cory is the name of a British king of, Richard I, who reigned from 1189 to 1199.† Richard Cory is a well know king of England, which was a king that fought against his own family, and well known to the public for his bloody fights he had encounter with other countries. The song â€Å"Richard Cory† by Simon and Garfunkel contradicts itself with two different views, one part is the fact that â€Å"he was born to society, a bankers only child† with â€Å"power, grace and style† every man wishes they had. Some parts of the song contradicts the poem because it does not mention in the poem that Richard Cory has a factory and that people work for him, but in the song it clearly mentions that he has a factory, making people who work for him curse the life they have. Seen the good quality of life that Richard Cory lived in made them wish that they could be him instead of â€Å"waiting for the light† (Cummings). Simon and Garfunkel quoted in their song â€Å"The papers print his picture almost everywhere he goes Richard Cory at the opera, Richard Cory at a show†. The song makes Richard Cory be as a celebrity, a person well known to society but also a person with class and a passion of been in social events rather than being a lonely person like it is mention in the poem. Other parts of the song that contradicted the poem, quotes â€Å"He freely gave to charity, he had the common touch, and they were grateful for his patronage and thanked him very much† (Simon and Garfunkel). People see a different Richard Cory, a guy that tries to help people and offers charity for people who are poor; they thanked him for all his contribu tions. In the poem he is known as a stock up and arrayed individual, who demanded the people around him. Some of the things we can easily see in the poem and in the song are politics. First the author Edwin Robinson talks in the poem about how he was â€Å"richer than a king† and â€Å"admirably schooled in every grace.† Richard Cory is seen as a king probably the king of England, who reins a country and wanted control over all the nations around him. Some of the problems was that they saw Richard Cory having maximum power, this made people be fearful at what he can do by harming its own people. His followers wish they had the same power as he did, disturbing the minds of those people made him belief that he had all the power and that they need to be just like him to gain the things he had, at least the selfishness he had just because he had maintain a well style of life with food and luxury. In the other side the song has different view of the Richard Cory he makes â€Å"political connections to spread his wealth around.† The song writer Simon and Garfunkel want the writer to see Richard Cory not as a king but rather as a guy with political influences that can control the way he can spend his wealth and capacity of controlling the things he has and gaining trust in the workers. When it says â€Å"wealth around† it a significance that Richard Cory according to the song wants to expand the use of his wealth and duplicated the things he has or it could also be that he wants to share the wealth to those people that envy him and want to be just like him, making them feel for a moment be just like him. Other issues that concern some will be the power that Richard Cory already has may cause him to want more power and be as powerful as a king, which in this will see the man with a monarchy, governing all the men and unsatisfying the peoples needs causing the mistru st in all the people and even himself. Some of the specifics that are encounter in the poem and song are that The influences of society over Richard Cory clearly, is obvious when the author Edwin Robinson makes Richard Cory as a handsome and wealthy person, making people want to be in his position because of the happy life he has. What society did not see was that inside that smile there was a man that did not have a perfect life, like everyone thought he had. The issues that Richard Cory had were hidden because he did not want society to know his lonely life; probably not having a family or love to share with. People could have provoked Richard Cory to kill himself because they talk too much about him, leaving him with almost no choice but to kill himself. Because he probably wanted to show the town that although he had money he was not happy with his life. Richard Cory was seen as a gentleman, and well schooled, he got tired of people only caring about what he had rather than the feeling that he wanted to give to people. This proves the quotes â€Å"money cannot buy you happiness it only buys isolation,† also, The poem â€Å"Richard Cory† wants humanity to realize that there are problems on thinking that been rich is everything in the world and reaching this is the fulfillment of happiness but like in the poem been wealthy may cause many people to kill themselves because they are not satisfy. He had everything he needed, everything he wanted but he did not have the valuable thing that a human being needs, happiness Yes, he helped the poor and also gave jobs to the needy but by doing that he was trying to buy peoples affections, so he would have friends. It is peoples natural instincts that if they cannot treat each other as humans with respect and love, then they will separated from the others in order to satisfy their own needs Overall, the poem and the songs had a meaning to each reader taking it from the egoism or the unhappiness that Richard Cory had, that ended up on killing himself with a pistol that went through his head. Of course, in reality there could be things that happen to people who are miserable because they do not have anyone to share their wealth. Like the things that were brought to the poem about who was really Richard Cory, the politics it brought as people so him as a king and probably the influences that people had over Richard Cory that ended up his life and brought knowledge to those people that thought that money has the happiness for all. Packaging for the new product Essay -- Design and Technology

Packaging for the new product Packaging is vital, as goods need to be transported to the consumer in a safe, hygienic and protected condition. The Assault: Part 1: Search For Victory :: essays research papers

I am a normal kid, well sort of. Everyone has those different things about them, for example: I fly planes, fence, and can perform geometry in my head. I am also a good shot with almost any type of gun. I am one of the best strategists in my school. Troon High School, the high school of Troon a town just north of Corpus Christi, Texas is one of the only schools in the state to have a fencing team. We have been the highest rated one in the state only the year I have been here. I am the second best, the best being another 9th grader, Drew Davis. Now, it's time to get to the story.I blocked a downward slash, then gave a weak thrust, mostly to give myself time to regain my balance. He moved back about two paces, I had gained ground. He still had one advantage over me, height. He always won using attacks from above. This match had been going on for about ten minutes, a very long time. The next thing he did surprised me, jumping high in the air; his foot came up and kicked my sword out of my hand. He thrust at me, but missed due to a backward flip on my part. As soon as I landed, I tried to kick his sword away, but his blade found the sensor above my heart. "Match over," the new scoring system announced, "Drew Davis wins over Justin Mills.""I'm still better than you, for all of your intelligence," he taunted at me.He always was trying to provoke a fight with me. Next was the self-defense class that our school was making required after what happened in Colorado. I guess they wanted students to be able to repel any future shootings. I personally think that teaching everyone to fight just gives them a weapon of their own. I hurried to class, yet was still late. "Remember," the teacher was saying, "if your opponent is armed, go for the hand. Never let the gun or knife aim at you. The best thing to do is kick the hand with the weapon."The teacher then proceeded to demonstrate the exact technique Drew used to disarm me in my last fencing match. It was almost the time to go to lunch when I heard Drew's voice come over the school intercom. "All students and staff, the school is now taken over.

How Golding Presents the Decline from Civilisation to Savagery in Lord

How Golding Presents the Decline from Civilisation to Savagery in Lord of the Flies Lord of the Flies is the name given to the inner beast, to which only Simon ever actually speaks. As Simon's waits for the beast's arrival near the bloody sow's head on the stake (buzzing with flies), The Lord of the Flies speaks to him, warning him not to get in its way or else he shall be killed by the boys. The Lord of the Flies name comes from the sow's head and the countless flies buzzing about it, which soon move from the sow's head to swarm around the head of Simon as the Lord of the Flies tells him, "I'm a part of you." In biblical texts, the Lord of the Flies is the title of Beelzebub (a direct translation of his name), a demon of Hell. There is a clear distinction between this book and The Coral Island. There is no separation between boys and savages, good and evil, Christianity and cannibalism, British and savages in this book, where as in the Coral island this distinction comes out many times. Jack is the novel's primary representative of the instincts of savagery, violence, and the desire for power, which is shown from the beginning. When the idea of having a Chief is mentioned, Jack speaks out immediately. "I ought to be chief," Jack says with simple arrogance, "because I'm chapter chorister and head boy." He is furious when he loses the election to Ralph, which subtly begins their conflict, and continually pushes the boundaries of his subordinate role in the group. Jack and his compatriots are portrayed as militaristic and aggressive, with Jack's bold manner and the choir marching in step with one another. They are the first concrete entrance of civilization onto the island and a decidedly negative one; ... ... is the conflict between two competing impulses that exist within all human beings: the instinct to live by rules, act peacefully, follow moral commands, and value the good of the group on the one hand; and the instinct to gratify one's immediate desires, act violently to obtain supremacy over others, and enforce one's will on the other. These two instincts may be called "the instinct of civilization" and "the instinct of savagery," as one is devoted to values that promote ordered society and the other is devoted to values that threaten ordered society. Throughout the novel, the instinct of civilization is associated with goodness, while the instinct of savagery is associated with evil, and the latter prevails. It is only at the very end of the book that the group is drained of savagery, as the captain pictures these small, ragged, confused little boys.

Langston Hughes Impact on an Era Essay

Langston Hughes contributed a tremendous influence on black culture throughout the United States during the era known as the Harlem Renaissance. He is usually considered to be one of the most prolific and most-recognized black poets of the Harlem Renaissance. He broke through barriers that very few black artists had done before this period. Hughes was presented with a great opportunity with the rise black art during the 1920’s and by his creative style of poetry, which used black culture as its basis and still appealed to all ethnicities. Until the Harlem Renaissance, poetry and literature were dominated by white people and were all about white culture. However, during the 1920’s, there was an explosion of black literature and, art poured from black artists and activists who represented black pride and individuality from the white dominance (â€Å"The Harlem Renaissance, Washington†¦Ã¢â‚¬ Online). This movement was sparked in the lower and upper Manhattan sections of New York City. Originally known as the New Negro Movement, it later became known as the Harlem Renaissance due to where it was birthed and seemed to be the area that it burned the most intense. One of the reasons why there was a rise in black culture in the Harlem area is due to the great migration of blacks to Northern cities during the early 1920’s. Racial discrimination, segregation, and interracial tension were also contributing factors to the Harlem Renaissance. Blacks were tired of being part of white America and wanted to break free and express not only black pride but, black culture as well. Langston Hughes emerged as one of the front men of the black movement of expression and art through the use of his poetic writing (â€Å"Harlem Renaissance† Online). Hughes wrote novels, plays, short stories, essays, and children’s books but, he focused most of his attention on poems. Most of Hughes better-known poems were written at the height of the Harlem Renaissance. Hughes was born in Joplin, Missouri, where he was raised primarily by his mother (Howes and Slovey 56). In 1921 Hughes enrolled at Columbia University in New York City. While in New York, Hughes became more intrigued with the rise of black culture in Harlem as opposed to his schoolwork. During the course of the next few years Hughes would make a name for himself with some of his famous  works such as the poem â€Å"The Negro Speaks of Rivers† and his book The Weary Blues (Howes and Slovey 58). However, he first gained recognition from some of his poems that were put in an anthology called The New Negro. He gained praise from not only blacks but, also from white supporters of the Harlem Renaissance (Strickland 31). He had made his way into the mainstream of great p oets and was making an impact for not only himself but for the black community with his creative poetic style (Wagner 386). How could one black man stand above all the other emerging black artists as much as Langston Hughes did? Hughes wanted to speak for the black community which he was so immersed in. He wanted to do it in a way though that the readers, especially blacks, were able to relate on a personal level to his poems. He did this by use modern forms such as free verse where he did not have to follow a pattern or use rhymes. He sought to make his poetry easy to understand but at the same time portray black culture with both realism and dignity (Howes and Slovey 59). He also wrote in black dialect and used black culture such as jazz to present his poems. He would not only use the freedom in his poems like jazz did but, he would also write to the rhythm and beat of jazz music which made it flow with a different style. He spoke of both the low times and the good times of the black community (Strickland 32). The style, the simplicity, and the culture that was presented in Hughes poems are what made him shine above other black artists. This is how one man went off on his own path and affected black literature as much as he did. Hughes affected the world of poetry during an era that was enriched with the rise black culture by using his own creative style. He drew not just the black communities praise but, the dominating white cultures as well. He has proven by his success to be one of the greatest influences during the Harlem Renaissance. He made a path for both the black community in general and the world of poetry on the whole. Works Cited â€Å"Harlem Renaissance.† MSN Encarta. 3 November 2004 . Shareholders basic on the wholey bring risks such as fraud, where the directors took control over the assets belonging to the phoner by using it for their someoneal use up, and mis counsel, whereby directors do an incompetent finality with the financial rest of the order.Furthermore, section 9 similarly defines the statusholder of a corporation, which fundament all toldy includes association executives who held senior positions in the identity cardlevel. This applies to Adler even though he was not properly appointed as a direc tor or an officer of the subsidiary. Since he has the role of director, the subsidiary retention comp each and also a constituent of HIH enthronement committee, this has showed that he participated in the ratiocination making of the bon tons vexation in which affected it the whole or substantial part of the melodic line.As Santow J gave his public opinion on this case, he gave a good summary of principles applic qualified to directors duties. several(prenominal) of it are a director must(prenominal)iness continuously kept informed of the activities of the companion, they must be familiar with the fundamentals of the rail line whereby the come with is doing.Section 180 certificate of indebtedness To Act With Care And DiligenceIn the section 180(1), it provides that a director or former(a) officer of a company need to coif their designers and discharge their duties with a standard of care and diligence in which a bonnie person will do if they were the director or o fficer of a company due to companys circumstances (section 180(1)(a)) and occupied the office and had the same responsibilities in the company as the director or officer (section 180(1)(b)). executive director directors are full time employees of the company who involved in the day-to-day management of the company. They have special responsibilities with their position and have a high knowledge of passing(a) operations of thecompany. Non-executive directors, on the some other hand, do part-time and have regular involvements in the company. In the case of ASIC v Adler, Williams who was the managing director for HIH and HIHC as well, contravened section 180(1) as he failed to ascertain there were proper shelter before HIHC gave the bring to take in. Fodera, who was the finance director of HIH, contravened section 180 as he failed to discuss a proposal to give $10 million loan to seduce to the HIH board or its coronation committee. As the executive directors of the company, tw o Fodera and Williams failed to carry out their role properly without informing the HIH board of their intention.Section 180 (2) The Business appraisal RuleIn the section of 180(2), the section provides that a director or any other officer who makes a business thought principle, will not be held liable in respect of the apprehension under the statutory, common law or equitable duties of care and diligence, in which all of the elements can be shown. Such elements are, the perspicaciousness was properly made in good faith and for proper purpose, there was not material personal divert in the subject as of the issue of the persuasion, the directors and the officers informed themselves about the subject matter of the shrewdness to the extent they appropriately believed to be reasonable and also the assessment was believed to be in cerebral in the outgo refer of the whole company. All of these would be fairly justified unless any other person in such position thinks that it is all told unreasonable. The business judgement see basically gives the directors with a refuge protection from a personal obligation in the copulation of the business judgements that they take are sensible which is in a good faith and in the best relate group of the company. This is because some of their business decisions may turn out to be profit-making or a centre loss in honest and rational way. Some of the main reasons for the business judgement rule defences are risk winning and activities in entrepreneurial activities will be encouraged since directors are aware of the specialized legislation that if they act honestly, they will not be punished or personally liable as a direct of adverse judicial review. Another rule defence is that best(p) business judgement will be made as a result of removing of some suspense of liability under the statutory duty of care and finally, the shareholders matter to are better provided by engaging risk victorious activities. To make directors be liable for such small errors of decision will nurture risk-adverse decision-making with contrast effect on the economy. If the directors or other officers are able to gratify the above requirements, they will have safe protection which makes them to be protected from liability for any breach of their duties of care and diligence. This pith that their business judgement in such situations will be reviewed by court. at a lower place section 180(3), the business judgement is defined that any decisions to take or not to take action with respect to matter that is relevant to business activities of the company. This only refers to business decisions that has made relevant to the business activities. It does not include any decisions made in the position of directors authors such as the power to issue shares or pay dividends.By referring to the case ASIC v Adler, the court held that all three Adler, Williams and Fodera breached their statutory duty of care as stated in section 180(1). They also, however could not deposit on the business judgement rule as their defence. Firstly for Adler, the business judgement rule did not applicable for him since he cannot indulge the section 180(2)(b) since he had a contravene of interest in the relation of his decision to invest the $10 million payment from HIHC in produce. Secondly for Williams, the business judgement rule did not apply to him because of his failed to ensure the correct safeguards were enforced was not business judgement for the purpose in section 180(3). However, even this was a business judgement, since he was a major shareholder of HIH, he basically has material personal interest as in the section 180(2)(b). early(a) than that, Williams also failed to present any secern that his judgement was done in good faith for the proper purpose as stated in section 180(2)(a). Finally, Fodera cannot rely on his business judgement rule as he failed to refer the act of wee to the HIH board o r its investment committee. This was not a business judgement asstated in section 180(3).Section 181 Statutory Duty To Act In Good Faith And For A Proper PurposeUnder section 181(1), it says that a director or other officer of a corporation to exercise their powers and discharge their duties in bona fide (good faith) for the best interest of the company and also for a proper purpose. The section 181(1) can be contravened if the director thinks that they are actually doing their duties for the best interest of the company in which any other director, in that situation, thinks that is clearly unacceptable lift to do it. This may be draw when a director have a conflict of interest personally with the interest of the company they are handling. In the case of ASIC v Adler, it can clearly be seen that Adler, had contravened the section 181(1) to act in good faith by properly excising his powers and discharging his duties for the best interest of the company. This is because, the deali ngss that occurred in the HIH, HIHC and make believe had been improperly used, for the sake of his personal interest.Section 182 ill-timed Use Of PositionUnder section 182, the section states that it restricts officers or the employees of a company from improperly using their power to recognise advantage for themselves or for any other persons to the company. In the case of ASIC v Adler, the court held that Adler had contravened the section 182 due to the parade of $10 million loan from HIHC to earn which was then to be used to perplex HIH shares on the stock market. This transaction was scarcely done for the purpose of supporting the HIH shares to outgrowth the set and thereby interchange the HIH shares owned by Adler Corporation before PEE could shit off their HIH shares. Because of this transaction, PEE had incurred a total loss of investment by reselling on the HIH shares. In regard of this transaction, Adler was held that he had improperly used his position as a direc tor of HIH, officer of HIHC and director of PEE to gain advantage for the Adler Corporation. The court also held that Williams, also had breached his duties as a director for both HIH and HIHC under section 182, to help gaining advantage for Adler Corporation. This is because Williams, used his position improperly by authorising the $10 million load payment without proper praise from the HIHs investment committee, which he was undeniable to disclose under the HIHs investment guidelines.Other than that, the court also held that Adler improperly used his position as a director in the PEE transactions of acquiring a number of ex-directory capitals at the cost monetary value from Adler Corporation without obtaining independent valuations of these ventures. With these transactions successful, Adler and Adler Corporation was able to exclude himself from these commercially unviable business operations. Adler basically knew that each of those businesses were having major cash guide prob lems and each had a significant risk that they would ultimately collapse. Adler, however, failed to disclose his personal interest to the HIH board other than Williams and Fodera.Section 183 Improper Use of InformationAs stated in section 183, a person who gets study because they are or are not director, officer or employee of a company, must not misuse the information just to gain advantage for themselves or to any other person whereby make failure in the company. Section 183 also applies towards resigned or retired directors, officers and employees as well. Informations such as insider information can be taken as an advantage by any person in order to gain benefit by using it to themselves or by giving to other person. In the case of ASIC v Vizard, the court held that Vizard involved in the contravention of section 183, whereby he gained the insider information as he was the non-executive director of Telstra. He misused the information in order to gain advantage for CTI, Brigha m and himself as well whereby based on the information that he receives (Telstra boards decision to charterother company and selling their interest on another company), he would act accordingly to debase or sell off his shares ahead of Telstra.S260A monetary AssistanceIn section 260A, the section states that it forbids a company financially assisting a person to obtain or acquire shares in the same company of its dimension company. However, if some of the conditions are met then the company may proceed to do such transaction. Some of the conditions are, giving the financial assist will not materially disfavor the interest of the company, its shareholders or the companys ability to pay its creditors (under section 260A(1)(a)), the financial assistant is validated by the shareholders (under section 260B) or the financial economic aid is jutting or exempted (under section 260C).Financial assistance is can be basically referred to where a company is lending money to a person t o buy the company shares. This performer that the company gives a certain nitty-gritty of money to a person so that the person buys some of the companys shares. Another prototype is where a company gives a surety or guaranteed a persons loan in which the sum of the loan will be proceeded to buy shares in the company. The company is basically providing a loan to a person for the sake of buying back its own shares off the stock market. Another example is where the company is giving its own assets as a security to a persons loan in which the loan money will be used to buy the shares of the company given its assets as security. The section 260A clearly states that a company is restricted from giving financial assistance to a person to buy its own shares in the stock market as it will cause material prejudice. By analysing the case of ASIC V Adler, it can be seen that Adler, who was controlling PEE, was clearly contravened the section of 260A by which giving financial assistance to PEE through HIHC, a subsdiary of HIH, which is also a company controlled by Adler. This financial assistance given to PEE, was then used to buy the HIH shares on the stock market. This transaction gives a false impression over the stock market as well as its investors that Adler was supporting the falling shareprice of its company, HIH, by buying the shares personally. However, the court show out that Adler does not have the intention to make easy profit and reselling the HIH shares. The real(a) purpose was to increase the HIH share price in benefit of Alder Corporation Limited as substantial shareholding in HIH. The actual evidence is that when PEE went to sell off the HIH shares, it was done only subsequently Adler Corporation decided to sell off its HIH shares in which leads to total loss for PEEs investment. The Supreme Court of sunrise(prenominal) South Wales held that the main intention of the transaction was that HIHC gave PEE financial assistance in order to acquire the shares in HIH which is HIHCs holding company. Due to this transaction, according to Santow J, both HIHC and HIH suffered material prejudice, which therefore, contravening section 260A.
